Maraga’s ordered all presidential candidates, including Jubilee’s Uhuru Kenyatta to respond to a case that has challenged the Thursday poll championed by the head of state.

Maraga responded to a petition filed before the Supreme Court that had sought to stop the IEBC and its Chairman from conducting the October 26 election.

The case filed by three Kenyan voters, had earlier suffered a setback after Interior CS Fred Matiang’i declared Wednesday a public holiday supposedly to enable voters to travel ahead of the repeat poll.

Maraga, however, stated that the case would go on regardless of the fact that Wednesday would be a public holiday.

He also directed the petitioners to serve all candidates by Tuesday afternoon.

“The respondents and all presidential candidates to file and serve their responses as well as written submissions by 8.30 am tomorrow morning. Matter to be heard tomorrow notwithstanding it may be a public holiday,” Maraga in his directions.
