In her application, Ms Wairimu said that her rights were violated when she was arrested over the murder, without a warrant of arrest.
According to High Court Judge, Justice James Makau, he has no authority to hear Sarah Wairimu’s application.
Sarah Wairimu was arrested and charged with killing her husband Tob Cohen and was remanded at the Lang'ata Women's Prison for about 40 days.
She was later on released on a Sh2 million cash bail.
