Surprising detail makes police refuse to release Waititu's wife after she paid bail

Kiambu Governor Ferdinand Waititu's wife Susan Ndung'u was on Tuesday sent to Lang'ata Women's remand facility despite having cleared her Sh4 million bail with the courts.

The investigating officer was surprised to find out that the governor's wife does not have a passport.

The officers, who did not believe her or her lawyer John Swaka, demanded a letter from the Immigration Department to confirm that she does not have a passport.

Mr Swaka noted that the letter could only be presented on Wednesday morning leaving his client with no option but to spend a third night in custody.

Governor Waititu appeals bail terms

Her husband, Governor Waititu, spent the night at Industrial Area Remand Prison after he failed to clear the Sh30 million bail requirement handed to him by Chief Magistrate Lawrence Mugambi.

On Wednesday morning, his lawyer Tom Ojienda filed an appeal in court claiming that his client could not raise the amount.

"The bail terms are in excessive, disproportionate, harsh, unjustifiable and should be reviewed downwards.

"The bail and bond terms are excessive issued per incuriam and the terms amount to a constructive denial of bail and bond without compelling reasons," the application stated.

The court directed to have the Governor remain in custody for two more nights pending the hearing of his bail review application on Friday.
