The IEBC moved to the Court of Appeal after Judge George Odunga declared that the appointment of the returning officers in the repeat presidential poll was flawed.

Legal experts had opined that while Odunga’s ruling did not automatically stop the Thursday election, the ruling had set the ground for the nullification of controversial election.

Fortunately, the IEBC legal team was able to quickly get a hearing at the Court of Appeal where Odunga’s ruling was lifted at around 9pm.

A section of Kenyans took to their social media accounts with some expressing suspicion in the timing of the Court of Appeal ruling.

Despite being a public holiday, the Court of Appeal managed to a three-judge bench including justices Erastus M Githinji, Martha Koome, and Fatuma Sichale.

The Supreme Court had earlier failed to raise quorum needed to hear a case seeking to stop the election.
