Justice Francis Tuiyot in his ruling said that the election was not free and fair.

Judge Tuiyott at the same time ordered Kolosh to pay Sh1 million in election costs.

The ruling came moments after the ODM lost yet another parliamentary seat after the election of Embakasi East MP Babu Owino was nullified.
